The Law Addresses Actions

Thomas Sowell has written anexcellent columntoday concerning gay "marriage". In this column, Dr. Sowell addresses why, from a matter of law, that "gay marriage" is not a matter of equal protection under the law, but a matter of unequal treatment of actions under the law.

As I have blogged here before, marriage is not a civil right, and co-habitating with another person of your choice is not illegal, no matter how immoral or repulsive the reasons may be to common sensibilities.

As I have stated numerous times, I am not afraid of the gay people. They would not bother me if they just did their thing and kept it to themselves. I do not approve of the behavior. I do not approve of a lot of behavior that goes on today. Behaviors that I do not agree with are not necessarily going to be illegal, even if immoral.

I do not approve of binge drinking. I do not approve of using God's name in vain. I do not approve of pornography. I do not approve of homosexuality. All of the above are immoral, but not illegal. And although people have the priveledge of living in a nation such as the U.S. where they can partake of such behavior, this does not mean that such behavior is considered profitable to society, and therefore should be sanctioned by law.

One could make the argument that marriage should be no concern of the state, but then women and children would definitely get the short end of the stick.

The question in my mind is this: is marriage a matter of secular legality or is marriage a matter of religious and public committment.

In terms of the state, for a marriage to be legitimate, a couple must petition for a marriage license. Herein is the true desire of the homosexual marriage crowd. They want the state-sanctioned piece of paper so that their lifestyle is then legitimized at the government level.

Take the piece of paper out of it. Dr. Sowell's point is that many women, because most do minimize their financial contribution during child-rearing years, would suffer because of low-life men who will not take responsibility taking off and leaving them with children to support with no legal means of gaining some equity from their non-financial support of the household.

But what constitutes a marriage? Is it the piece of paper from the state? Or is it the committment of a man and woman to one another, vowed before God and witnesses of man, and the consummation of the vows that constitute the marriage? And is marriage not a matter of biblical doctrine and religious tradition, from which this practice is drawn?

If marriage is nothing more than the piece of paper, then marriage is not worth a lot anyway. If marriage is the committment and consumation in biblical doctrine and religious tradition, then homosexual marriages would not be legitimate anyway.

In terms of shacking up, I believe that biblical doctrine of marriage covers that as well. Living together without vowing committment and swearing off all other partners is not legitimate marriage.
